Does jaywalking prevent you from filing a personal injury claim?

If you suffered an injury while crossing a street outside a crosswalk, you may wonder whether that single decision forecloses any chance of recovery. It is a common concern, and the answer under Florida law proves more nuanced than a straightforward yes or no.

Comparative negligence and your claim

Florida operates under a modified comparative negligence system, a framework established through sweeping tort reform legislation enacted in March 2023. Under this system, the court reduces your compensation by the percentage of fault assigned to you, but you do not automatically lose the right to seek recovery.

If a court finds you more than 50% responsible for your own injuries, compensation is no longer available, but if your share is 50% or less, you may still pursue a claim reduced by that percentage.

Suppose a jury assigns you 30% of the blame for crossing where you should not have. In that case, the damages award goes down from $100,000 to $70,000.

Driver duties and pedestrian rules

Under Florida law, all drivers have a legal duty to exercise due care to avoid collisions with pedestrians. That duty applies at all times, regardless of whether the pedestrian is inside or outside a crosswalk.

Pedestrians carry their own set of legal obligations as well. The state’s pedestrian traffic regulations require individuals to use sidewalks where they are available, obey traffic signals at intersections and yield the right of way to vehicles when crossing outside of marked crosswalks. Violating these rules may contribute to a finding of partial liability.

In a jaywalking scenario, however, the driver’s conduct is still part of the equation. If the driver was speeding, looking at a phone or impaired at the time of the crash, those factors can shift a large portion of fault away from the pedestrian.

Strong evidence and timely action

Because outcomes turn on percentages, the evidence gathered after a crash carries considerable weight. Photographs of the scene, video from nearby cameras, witness accounts and medical records can each influence how the court assigns responsibility, and the sooner you collect those documents, the clearer the resulting picture tends to be.

Florida’s statute of limitations for most personal injury claims is now two years from the date of the accident, a deadline that was shortened under the same 2023 tort reform law. Missing that window may mean losing the right to file a lawsuit, no matter how strong the facts of your case may be.

It is also worth knowing that fault percentages are not set in stone. Insurance adjusters may try to place a higher share of blame on you as part of the claims process, and having legal counsel can help you present evidence that paints a more complete picture.
